Negligence enshrined in Law (if you are the State)

Debbie Purdy won, and I am pleased there is going to be some clarification in the Law from the DPP

BUT

Andre Power lost

I lost! Mr Justice Blair agreed with the defendants that the case should be dismissed because agents/servants of the Crown who are negligent in their duties are not liable in law, so they can do what they like and we have no recourse. Does anyone see the bitter irony in this? The Ministry of Justice at The Royal Courts of Justice won by arguing that Justice should not apply to the select elite who work for them

We officially now have a two tier legal system one for the righteous and one for the rest of us. The Crown can sue ABC Ltd or Joe Bloggs but ABC Ltd or Joe Bloggs cannot sue the Crown for negligence.

The irony of it being another Blair who made this decision.

If the guy's life has suffered because of the state, perhaps he could make a fresh challenge under the Human Rights Act rather than negligence?

Of course I am not a lawyer...

does "agent of the crown" include a policeman or soldier? if so, does this mean you can't sue them for being wrongfully arrested, shot, etc etc?

and yes it is bullshit, how hard can it be to swallow some sleeping pills?

If she slips beyond being capable of slurping through a straw then who is to say she hasn't changed her fucking mind!

Now this wonam will be the key the goverment/EU need to start putting social and financial pressure on families to try and get them to snuff out the most vulnerable!

I hope one day your children pressure you into signing one and when you lose a few marbles they bump you off, after all the goverment will say it's best for everyone, but hey don't hang the murderers, that would be evil!

C'mon, OH, what did you expect? The State includes the judiciary. If the State is made responsible for its mistakes that means judges are answerable for theirs. Is a judge likely to rule that he is liable for his incompetence?

The agents of the Crown may not be liable but the Crown (I assume) remains so. That could easily wend it's way into circular arguments - Assuming that the Polic are classed as agents of the Crown, let's say you get run down by a copper. You can't sue them as an idividual but you can sue their Force. The Force could then wriggle out of it by saying the copper hadn't followed his or her training. The Force did all that was reasonable and the copper is untouchable.

People absolved of their responsibilities become irresponsible. We are in for a world of hurt with this one.

To the judge's credit, he refused to be considered for an appointment while his brother was PM and is there on merit.

Of course judge Bleuh doesn't want individual agents of the state to be liable.

Imagine, if all the NOK's of the dead and injured servicemen and servicewomen lined up for a slice of smug Bleuh's and letterbox gob's wedge.

So the only way we can get justice now is - if a Plod roughs you up, find out where he lives, put a petrol bomb thru the letterbox at midnight & run like fuck. They will be accountable, one way or another.

haven't a clue, a few minutes of googlage brought up EU directives regarding emergency planning, llike a EU FEMA with authority over member states in times of emergency.

About the civil protection unit

It explains FUCK ALL.

Planning – continually assessing the risks posed within Luton and developing and maintaining plans

WTF kinda circular explanation is that.

Training and exercising – a programme of training for our partner agencies and other relevant persons will raise awareness for the need to plan, and provide necessary advice and guidance.

Again, training for plans? What plans.

Liaison – The CPU works closely with partner agencies and stakeholders to ensure plans and procedures are co-ordinated and integrated in response to emergency incidents.

Operational – during an emergency the unit plays a senior role in co-ordinating the response, and provision of support. The unit is likely to lead any reconstruction or recovery to restore the community.

Without further investigation, my spidey senses tell me this is another long arm of the EU.

It is also the name of the masked thugs-of-the-state in Half Life 2 that I loved to kill en masse because they seemed to love to club you for no fucking reason.
